South Africa’s Minister of Trade, Industry and Competition, Parks Tau, has launched an appeal against the Competition Tribunal’s October decision to block Vodacom Group Ltd.’s $730 million (13.2 billion rand) acquisition of a stake in Remgro Ltd.’s fiber businesses, Bloomberg reports.

This unprecedented move by the recently appointed minister directly challenges the country’s antitrust regulators and throws the future of a major infrastructure investment into doubt.

The appeal, seen by Bloomberg News, seeks to overturn the Tribunal’s ruling and allow the merger to proceed. The deal, which includes a planned 10 billion rand investment in fiber rollout to low-income areas and the creation of 10,000 jobs, has drawn significant industry support. Proponents argue that consolidation is vital for future growth and investment in South Africa’s digital infrastructure.

The Competition Tribunal’s rejection of the acquisition came as a surprise to many. Both Vodacom and Remgro have stressed the importance of the investment for expanding internet access in underserved communities. The appeal now puts the spotlight on the minister’s intervention and the potential implications for future mergers and acquisitions in the telecommunications sector.

The appeal has drawn a wide array of respondents, including Vodacom’s main competitor, MTN Group Ltd. A broad consensus within the industry favors the deal, recognizing the need for consolidation to unlock further growth.

Minister Tau’s appeal represents a significant challenge to the Competition Tribunal’s authority and sets the stage for a crucial legal battle with far-reaching consequences for South Africa’s digital infrastructure development and its regulatory landscape.
