Wyoming Federal Court to Hear Arguments in Free Speech Lawsuit Against Governor

On November 8, the United States District Court for the District of Wyoming will hear arguments in a First Amendment lawsuit filed by the Liberty Justice Center (LJC) on behalf of Dr. Eric Cubin, a Wyoming physician.

The case, Cubin v. Gordon, claims that Governor Mark Gordon violated Dr. Cubin’s First Amendment rights by pressuring him to resign from the Wyoming Board of Medicine due to his public support for a state bill, Chloe’s Law.

The preliminary injunction hearing, set for 1 p.m., will see Liberty Justice Center Senior Counsel Buck Dougherty, joined by Wyoming attorney Steve Melchior, make a case for Dr. Cubin’s reinstatement. The attorneys will argue that the Governor’s actions amounted to unconstitutional retaliation against Dr. Cubin for his advocacy. The Liberty Justice Center contends that this move infringed upon Dr. Cubin’s free speech rights and seeks court intervention to uphold these rights, with a ruling anticipated before year-end.

The dispute centers around Chloe’s Law, legislation enacted earlier this year to protect minors in Wyoming, which Governor Gordon himself supported and signed into law. However, Dr. Cubin was dismissed from the Board of Medicine after sending a letter to Wyoming legislators endorsing the measure. Despite the Governor’s subsequent praise for Chloe’s Law, Dr. Cubin’s support of the bill allegedly led to his ousting.

In its filings, the Liberty Justice Center argues that Governor Gordon’s response contravenes constitutional protections for free expression, and they aim to hold state leadership accountable to these principles.
