Wyoming Welcomes First Chancery Court Judge in Historic Swearing-In Ceremony

Wyoming marked a judicial milestone on Thursday as Judge Benjamin Burningham was sworn in as the state’s first-ever Chancery Court judge during a ceremony at the Thyra Thomson State Office Building in Casper, Oil City News reports.

The ceremony, attended by state officials, supporters, and family members, was presided over by Wyoming Chief Justice Kate Fox. Judge Burningham’s appointment follows the establishment of the Chancery Court in 2019, aimed at expediting the resolution of business disputes.

Governor Mark Gordon appointed Judge Burningham in November, recognizing his extensive legal experience and dedication to the state’s judicial system. Before this, Wyoming’s Chancery Court duties were handled by rotating district court judges. The newly inaugurated Chancery Court, located on the third floor of the Thyra Thomson State Office Building, is designed specifically to handle business disputes in a fast, fair, and cost-effective manner.

“This is an exciting day for Wyoming,” said Chief Justice Fox in her opening remarks. “With 47 filings this year alone, the Chancery Court is proving its value to our state’s business community. Now, with Judge Burningham at the helm, we’re ready for the next chapter in this court’s development.”

Judge Burningham expressed his enthusiasm for the role, calling his appointment a significant milestone.

“Chancery courts and modern business courts are essential for creating competitive state marketplaces by providing efficient and cost-effective resolutions to disputes,” he said. “I’m honored to contribute to this historic effort and look forward to enhancing Wyoming’s judicial system and marketplace.”

Burningham pointed to Delaware’s Chancery Court as a model, noting its reputation as the “gold standard” for business litigation. He hopes to replicate its success to attract businesses to Wyoming and bolster the state’s economic environment.

Prior to his appointment, Judge Burningham served as the Chief Legal Officer for the Wyoming Judicial Branch, where he contributed to the development of the state’s legal framework. He also held positions as Chief of the Consumer Protection Antitrust Unit in the Wyoming Attorney General’s Office and practiced securities fraud litigation in Washington, D.C.

Burningham’s diverse legal background uniquely positions him to lead the Chancery Court in its mission to handle complex business cases effectively.

The establishment of the Chancery Court underscores Wyoming’s commitment to fostering a business-friendly environment. Supporters believe the court will enhance the state’s ability to attract and retain businesses by providing a specialized forum for resolving commercial disputes.

Chief Justice Fox highlighted the growing interest in the court, noting the steady increase in case filings.

“Word is spreading, and Wyoming is positioned to become a leader in efficient business dispute resolution,” she said.
