Vestager’s Legacy Cemented by Recent Antitrust Court Wins
  • PublishedSeptember 12, 2024

Margrethe Vestager, the European Commission’s competition chief, is concluding her tenure on a high note following recent court victories against tech giants Apple and Google.

These successes not only reaffirm her position as a formidable advocate for antitrust enforcement but also mark a significant moment in her decade-long career.

This week, the Court of Justice upheld the European Commission’s decisions in two high-profile cases. Apple was ordered to pay approximately €13 billion in back taxes to Ireland, a ruling vindicating Vestager’s long-standing battle for tax justice. Similarly, the court upheld a €2.7 billion fine against Google for antitrust violations related to its shopping service practices. These judgments come as a boost for Vestager, especially after a challenging final year in office.

Vestager’s departure from the European Commission is framed by both triumph and controversy. Despite her recent court wins, her final year has been marked by several setbacks. Her candidate for a key EU role was forced to withdraw following French opposition, and she was unsuccessful in securing another prominent EU position for herself. Additionally, recent court rulings on merger policies and other issues cast a shadow over her otherwise impressive tenure.

Nevertheless, Vestager’s bold approach to antitrust enforcement has left a lasting impact. Her decisive actions against major tech firms, including launching the investigation into Google’s practices shortly after assuming office in 2014, have set a high bar for regulatory oversight. Her efforts have not only led to substantial fines but have also influenced how the European Commission tackles Big Tech.

Her tenure has not been without controversy. Critics have scrutinized her use of state aid investigations and her confrontations with powerful stakeholders, including the US government. Despite this, Vestager’s stance against major American tech companies and her commitment to tax fairness have garnered her significant support in Europe.

Vestager’s legacy is further solidified by her role in the enforcement of the Digital Markets Act, which provides new tools for tackling market abuses by dominant tech companies. Her tenure has been marked by a blend of strategic aggression and public engagement, earning her recognition and acclaim in both European and international circles.
